Home Inspector Buddy™ - Terms of Service

1. Acceptance of Terms

By accessing or using Home Inspector Buddy, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms, you may not access our service.

2. Definitions

  • "Service" refers to the Home Inspector Buddy platform.
  • "User" refers to any individual who accesses or uses the Service.
  • "Realtor" refers to users who access the platform to view and share property inspection reports.
  • "Buyer/Seller" refers to users who access the platform to view and share property inspection reports.
  • "Inspector" refers to users who upload photos, generate, and review reports.
  • "AI-Generated Content" refers to any analysis, reports, or insights generated by our artificial intelligence models.

3. User Accounts

3.1. Registration

  • Users must provide accurate, current, and complete information during the registration process.
  • Users are responsible for maintaining the confidentiality of their account credentials.
  • Users must notify us immediately of any security breaches or unauthorized use of their account.

3.2. Email Verification

  • All accounts require email verification.
  • Unverified accounts may have limited functionality.

3.3. Role-Based Access

  • Different user roles (Realtor, Buyer/Seller, Inspector) have specific permissions and access levels.
  • Users must not attempt to circumvent these access controls.

4. AI-Generated Content

4.1. Limitations of AI Analysis

  • Our AI-powered image analysis is provided "as is" and is intended as a supplementary tool only.
  • The AI analysis may not identify all potential issues, safety concerns, or code violations.
  • AI-generated reports should not replace professional home inspections by qualified inspectors.

4.2. Disclaimer for AI-Generated Reports

  • Users must acknowledge a disclaimer before accessing AI-generated reports.
  • By using our Service, you understand and agree that AI-generated reports:
    • May contain errors, inaccuracies, or omissions.
    • Are generated based on the specific images provided and may not reflect the complete condition of the property.
    • Should be verified by a qualified professional before making significant decisions.

4.3. Inspector Review and Edits

  • Inspectors may confirm or edit AI findings within the platform.
  • Edited areas are marked with the inspector's initials.
  • Inspector-reviewed reports do not constitute a complete professional home inspection unless explicitly stated.

5. Report Storage and Access

5.1. Storage Duration

  • Reports are stored for 90 days by default.
  • Users can choose to save reports indefinitely for an additional fee.

5.2. Privacy and Sharing

  • Reports are private and only accessible to logged-in users with appropriate access permissions.
  • Users can share reports within the app with other authorized users.

5.3. Export Rights

  • Users may export reports to PDF format for personal use.
  • Exported reports may not be modified or altered outside the platform.

6. Collaboration Features

6.1. Comments and Annotations

  • Realtors and buyers/sellers may leave comments or annotations on reports.
  • All comments and annotations must comply with our Code of Conduct.

6.2. Inspector Reviews

  • Users may request inspector reviews as a paid add-on service.
  • Inspector reviews are subject to availability and current queue status.

7. Inspector Queue and Priority System

7.1. Queue Assignment

  • Inspector review requests are automatically assigned based on availability and expertise.
  • Inspectors may pay to be prioritized in the queue for reviews.

7.2. Wait Times

  • Estimated wait times for inspector reviews are provided but are not guaranteed.
  • Actual wait times may vary based on demand and inspector availability.

8. Fees and Payment

8.1. Payment Processing

  • All payments are processed through Stripe.
  • By making a payment, you agree to Stripe's terms of service.

8.2. Fee-Based Services

  • Inspector reviews and extended report storage are available as fee-based add-ons.
  • All fees are non-refundable unless otherwise specified.

8.3. Fee Changes

  • We reserve the right to modify our fee structure at any time with appropriate notice.
  • Changes to fees will not affect previously purchased services.

9. Compliance and Regulations

9.1. Regional Building Codes

  • While our AI attempts to identify building codes specific to regions/states, we do not guarantee complete or current code compliance information.
  • Users are responsible for verifying all code compliance matters with relevant local authorities.

9.2. Legal Disclaimers

  • Legal disclaimers are included in all reports generated by our Service.
  • These disclaimers are an integral part of the report and may not be removed.

10. User Conduct

10.1. Prohibited Actions

Users agree not to:

  • Use the Service for any illegal purpose.
  • Upload false, misleading, or manipulated images.
  • Attempt to circumvent any security measures.
  • Interfere with the proper operation of the Service.
  • Impersonate any person or entity.
  • Harass, abuse, or harm other users.

10.2. Content Restrictions

Users agree not to upload:

  • Content that violates any third party's intellectual property rights.
  • Content that contains malware, viruses, or harmful code.
  • Content that violates any person's privacy rights.
  • Content that is defamatory, obscene, or otherwise objectionable.

11. Intellectual Property

11.1. Our Intellectual Property

  • The Service, including all software, features, and functionality, is owned by Home Inspector Buddy and is protected by intellectual property laws.
  • Users may not copy, modify, distribute, sell, or lease any part of our Service without explicit permission.

11.2. User Content

  • Users retain ownership of content they upload to the Service.
  • By uploading content, users grant us a worldwide, non-exclusive, royalty-free license to use, store, and process that content for the purpose of providing and improving our Service.

11.3. AI Training and Feedback

  • User feedback on AI-generated findings may be used to improve the accuracy of our AI models.
  • Uploaded images and reports may be used, in anonymized form, for AI training purposes unless users explicitly opt out.

12. Privacy and Data Security

12.1. Data Collection and Use

  • We collect and process user data as described in our Privacy Policy.
  • By using our Service, you consent to such collection and processing.

12.2. Data Security

  • We implement reasonable security measures to protect user data.
  • However, no method of transmission over the internet or electronic storage is 100% secure.

13. Termination

13.1. Termination by You

  • You may terminate your account at any time by following the instructions on our platform.
  • Termination will not result in refunds for previously paid services.

13.2. Termination by Us

  • We may terminate or suspend your account without prior notice for violations of these Terms.
  • We reserve the right to terminate or suspend access to our Service immediately, without prior notice, for any reason whatsoever.

14. Limitation of Liability

14.1. Disclaimer of Warranties

  • The Service is provided on an "as is" and "as available" basis without warranties of any kind.
  • We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

14.2. Limitation of Liability

  • To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.
  • Our total liability for any claims under these Terms shall not exceed the amount you paid us in the past six months.

15. Indemnification

You agree to indemnify, defend, and hold harmless Home Inspector Buddy, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any rights of another.
  • Your uploaded content.

16. Modifications to Terms

We may modify these Terms at any time by posting the amended terms on our platform. Your continued use of the Service after such posting constitutes your acceptance of the modified terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions.

18. Dispute Resolution

Any dispute arising from these Terms shall be resolved through arbitration in accordance with the rules of the American Arbitration Association in the United States.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms constitute the entire agreement between you and Home Inspector Buddy™ regarding our Service and supersede all prior agreements.
